Terms of Service Beta
1. Acceptance of Terms
1.1. Agreement to Terms
By accessing or using the Service (as defined below), you agree to be bound by these Terms of Service (the "Terms"). If you do not agree to these Terms, you must not access or use the Service.
1.2. Electronic Acceptance
Your use of the Service constitutes electronic acceptance of these Terms, which has the same legal effect as a written signature.
1.3. Acceptance Through Interface
By clicking "Sign Up," "Register," or similar buttons, or by continuing to use the Service after being notified of updates to these Terms, you affirmatively accept these Terms.
1.4. Additional Policies
These Terms incorporate by reference the following additional policies, which are available on our website:
- Privacy Policy
- Cookie Policy
2. Eligibility and Age Restrictions
2.1. Minimum Age
The Service is not intended for children under 13 years of age. By using the Service, you represent and warrant that you are at least 13 years old.
2.2. Users Under 18
If you are between 13 and 18 years old, you confirm that you have obtained consent from your parent or legal guardian to use the Service.
2.3. COPPA Compliance
We comply with the U.S. Children's Online Privacy Protection Act (COPPA). We do not knowingly collect personal information from children under 13. If we discover that a user is under 13, we will immediately terminate that user's account and permanently delete all associated data.
2.4. Age Misrepresentation
If you provide false information regarding your age, we reserve the right to terminate your account and delete all associated data without prior notice.
2.5. Reporting Underage Users
If you become aware that a user is under 13, please report it immediately to: gameup.me@proton.me
2.6. Legal Capacity
You represent that you have the legal capacity to enter into a binding agreement in your jurisdiction. If you are using the Service on behalf of an entity, you represent that you have the authority to bind that entity.
2.7. Games Age Restriction
Guest players: You may play Reversi and Backgammon in single-player mode without age verification. However, you acknowledge that these games are for entertainment purposes only.
2.8. Confirmation of Eligibility
To use the Service, you must confirm that you meet the following eligibility requirements:
- You are at least 13 years old
- You are not located in the European Economic Area (EEA) or the United Kingdom
How we record your confirmation:
For registered users:
- You confirm your eligibility during the registration process
- We store a confirmation flag in your account indicating that you have completed the confirmation
- This flag remains stored for as long as your account is active
- When you log in from any device, we check this flag and do not ask for confirmation again
For guest users (not registered):
- You confirm your eligibility the first time you use the Service
- We store a confirmation flag in your browser's persistent cookie
- This flag remains stored until you manually clear your browser cookies
- If you clear your cookies, you will be asked to confirm again on your next visit
Important:
- We do not store your actual age or actual location
- We store only a confirmation flag indicating that you have completed the confirmation
- We collect the absolute minimum information necessary to verify eligibility
- For registered users, this flag is associated with your account solely for the purpose of verifying eligibility across devices
- For guest users, this flag is stored only in your browser and is not linked to any account
Why this matters: This approach allows us to comply with legal requirements (COPPA, GDPR) while collecting the minimum amount of information necessary.
3. Geographic Availability and Restricted Jurisdictions
3.1. Limited Availability
The Service is currently offered on a limited basis during the Beta phase. It is available only to users who are physically located in jurisdictions where we expressly permit access.
3.2. Restricted Jurisdictions
The Service is NOT offered to persons located in:
- The European Economic Area (EEA) — including all EU member states, Iceland, Liechtenstein, and Norway
- The United Kingdom
- Any other jurisdiction where the Service may be subject to legal requirements that the Operator does not currently intend to comply with (as updated from time to time)
3.3. User Representation
By registering for and using the Service, you represent and warrant that:
- You are not located in any Restricted Jurisdiction
- You are not using a VPN, proxy, or other technology to circumvent these geographic restrictions
- You will not attempt to access the Service from any Restricted Jurisdiction
3.4. No Guarantee of Detection
While we may implement technical measures to block access from Restricted Jurisdictions, we do not guarantee that we can detect or block all such access. You remain solely responsible for complying with these geographic restrictions.
3.5. Right to Block Access
We reserve the right to suspend, terminate, or restrict your access to the Service if we determine, in our sole discretion, that you are located in a Restricted Jurisdiction, regardless of whether you used circumvention technology.
3.6. Changes to Jurisdictions
We may add or remove Restricted Jurisdictions at any time without prior notice, in our sole discretion.
4. Description of the Service
4.1. Core Functionality
gameup.me is a platform that offers:
- Real-time video communication and messaging (WebRTC)
- Private rooms for communication and collaboration
- Casual games (Reversi, Backgammon, and a 3D shooter)
- Tools (Graphics Editor, Audio Editor, and other similar applications)
- Wishlist feature (experimental)
4.2. Technical Architecture (WebRTC)
The Service uses WebRTC (Web Real-Time Communication) technology:
a) Signaling
Connection setup information (session descriptions, ICE candidates) is exchanged through our server to establish peer-to-peer connections.
b) Media Transmission
Audio and video streams are transmitted directly between users (peer-to-peer) whenever network conditions allow. We do not route, store, or process media content except as necessary for connection establishment.
c) STUN Servers
Used to discover public IP addresses and facilitate direct connections.
d) TURN Servers
Used as a relay when direct peer-to-peer connection fails. Media traffic may pass through our TURN servers in such cases, but no audio/video content is stored, recorded, or retained at any time.
4.3. No Recording or Storage
4.4. Beta Status
The Service is a pre-release Beta version. It is:
- Incomplete and experimental
- Subject to bugs, errors, and interruptions
- Subject to change or discontinuation at any time without notice
- Not intended for production, business-critical, or emergency use
- Provided for evaluation and feedback purposes only
4.5. Changes to the Service
We reserve the right to modify, add, or remove any features or functionality of the Service at any time, with or without notice.
4.6. Wishlist Feature (Experimental)
How it works:
- You can submit your wishlist items via the Service interface
- Name visibility: You may choose to:
- Display your chosen name (your display name or a custom name you provide) alongside your wishlist item
- Remain anonymous — your name will not be shown
- All submissions are reviewed by us before publication
- We may edit submissions for clarity, length, or appropriateness
- We reserve the right to reject or delete any submission at our discretion
Important notes:
- This feature is experimental and may be discontinued at any time
- We do not guarantee that your submission will be published
- Published wishlist items are visible to all users
- Do not submit personal, confidential, or illegal content
- If you choose to display your name, it will be visible to all users — choose a name you are comfortable sharing publicly
4.7. Games Feature
Game Modes:
a) Solo Mode (Outside a Room)
- Games run entirely in your browser
- No data is transmitted to our servers
- No game data is stored
- Available to all users (guests and registered)
b) Collaborative Mode (Inside a Room)
- When you are in a room, you may invite other room members to join your game
- Game data is transmitted in real-time through our servers to synchronize the game state between participants
- No game data is stored on our servers — data is only relayed and discarded after the session ends
- Available only to registered users in rooms
Access Summary:

4.8. Tools Section (Graphics Editor, Audio Editor, and other similar applications)
The Tools section includes various applications that run in your browser, such as:
- Graphics Editor (Paint)
- Audio Editor
- Other tools we may add in the future
Tool Modes:
a) Solo Mode (Outside a Room)
- Tools run entirely in your browser
- No data is transmitted to our servers
- No files or edits are stored on our servers
- Available to all users (guests and registered)
b) Collaborative Mode (Inside a Room)
- When you are in a room, you may invite other room members to collaborate on a tool
- Tool data (e.g., drawing strokes, audio edits) is transmitted in real-time through our servers to synchronize the workspace between participants
- No tool data is stored on our servers — data is only relayed and discarded after the session ends
- Available only to registered users in rooms
Important:

- We do not store any files on our servers
- You are solely responsible for the content you create or edit
- You must not use the tools to create illegal, offensive, or infringing content
- In collaborative mode, tool data is not stored — it is only relayed in real-time
4.9. Rooms Feature
The Service includes a "Rooms" feature that allows registered users to create private spaces for communication, collaboration, and shared activities.
How it works:
- Room creation: Registered users (room administrators) can create rooms. Each room is assigned a unique ID (e.g.,
/r/123456). - Room alias (optional): Administrators may optionally choose a human-readable alias (e.g.,
/r/my_room). Aliases must be unique and may be subject to moderation. - Room types:
- Temporary rooms: Automatically deleted after a period of inactivity.
- Permanent rooms: Persist until explicitly deleted by the administrator or by us.
- Access control: Rooms are private by default. Only users explicitly added by the room administrator can join.
- Invitations: Room administrators can generate invitation links to invite other users:
- For registered users: Clicking the invitation link allows them to accept the invitation and join the room.
- For unregistered users: Clicking the invitation link creates a temporary account with automatically generated login credentials. The user chooses a display name and joins the room. These credentials can be used to log in later.
- Shared activities: Once in a room, members can:
- Start collaborative games (Reversi, Backgammon, etc.)
- Use collaborative tools (Graphics Editor, Audio Editor, etc.)
- Communicate via video and messaging
Data transmission in rooms:
- When you use a game or tool collaboratively in a room, data is transmitted in real-time through our servers to synchronize the experience between participants.
- No game or tool data is stored on our servers — data is only relayed and discarded after the session ends.
- Video and audio communications are handled via WebRTC and are not stored.
Important notes:
- Room aliases are publicly visible in the room URL. Do not use personal or sensitive information as an alias.
- Invitation links are access tokens. Anyone with the link can accept the invitation and join the room (subject to the conditions above).
- We reserve the right to delete or rename any room alias that violates these Terms.
- We are not responsible for the content or behavior of users within rooms.
- Room data is stored as described in our Privacy Policy.
5. Accounts and Authentication
5.1. Account Creation
To use the Service, you must register an account. You agree to provide accurate, current, and complete information during registration.

We reserve the right to delete or rename any room that violates these Terms, remains inactive for an extended period, or at our sole discretion.
Upon room deletion:
- The room URL will become inaccessible
- All room data (members, aliases, metadata) will be permanently removed
- All outstanding invitation links will become invalid
- Temporary rooms may be automatically deleted after a period of inactivity
Invitation links: We reserve the right to revoke, expire, or invalidate any invitation link at any time, with or without notice.
Note: Room deletion does not affect user accounts or other data associated with the room members.
5.8. Future Data Storage (Optional)
In the future, we may introduce optional features that allow users to save game states, tool projects, or other content on our servers. This would be an opt-in feature, and we will:
